Oftentimes parties arrive at a mediation with a rigid view of their positions. It is hardly ever that one party “wins” a mediation. To reach a resolution, all parties must be inclined to examine factual and legal arguments that undermine their positions, and the chance that their positions might not win through in a trial; the uncertainty and costs of litigation.
Mediator - guides the parties to creative ideas, to identify and explore new options, and reach a negotiated agreement - of their own making - that is acceptable to all parties moving forward.
In mediation, the Mediator (as a neutral) shepherds the process for the parties to reach solutions which they themselves authored.
